The giant container ship Ever Given, which made captions after being stranded on the Suez Canal last month, was captured by canal officials. Particularly, the Suez Canal Authority (SCA) claims $ 916 million in losses for costs arising from the congestion of the ship’s waterway.
The ship will be kept until compensation is paid so that its 25 crew members will not leave the ship. Taiwanese shipping company Evergreen, who is the charterer of the ship, said all requested payments will be handled by the shipowners and Shoei Kisen, UK P&I Club liability insurance provider in London.
The P&I club has assured the company of third party liabilities that may arise from such an event, including claims for detriment or prevention to infrastructure. The ship itself and its cargo will be insured separately.
The UK Club said last week about an incident such as this:
“Despite the magnitude of the claim, which is largely unsupported, the owners and their insurers are negotiating in good faith with the SCA. On April 12, a carefully thought-out and generous offer was made to the SCA to resolve its claims.”
No consensus could be reached in the meeting between the shipowners and the SCA. On the 13th of April, the SCA immediately applied to arrest the ship, which was confirmed by the court.
The UK Club added that the SCA did not provide detailed justification for this “extraordinarily grand claim”:
“We are disappointed by the decision to arrest the ship today after the SCA. We were also disappointed by SCA’s comments that the ship will be kept in Egypt until compensation is paid and that its crew will not be able to leave the ship during this time.”
As reported, the right contains a claim of $300 million for a “bailout bonus” and $300 million for “loss of prestige”. This does not enclose the solicitor’s request for rescue services that shipowners and insurers expect to receive separately. The club explained that the P&I aspects of the claim are relatively moderate, except for the controversial claim of loss of prestige.
Responding to the arrest of the ship, Evergreen said it was reported by Japanese ship owners that Ever Given was formally arrested by the Court in Egypt on the 13th of April 13, 2021.
